These terms apply to agents, developers, lawyers, notaries and other professionals who create an account on HomeDominican, publish a profile or listings, or buy a paid plan or a sponsored placement. They add to the terms of use and the privacy policy.
1. Who can sign up
- Professionals of legal age, or legally incorporated companies, working in the Dominican Republic.
- You must be qualified for the work you offer: for example, admitted to practice and a member of the bar if you are a lawyer or notary. When the law requires a licence or registration for real-estate brokerage, you must hold it and give us the number.
- One account per person. You are responsible for keeping your password safe and for everything done from your account.
2. Vetting and publishing
- We review every profile and listing before publishing it, and every change before it goes live. We may ask for documents, reject or remove content that breaks these terms, and suspend accounts.
- Our vetting does not make us a party to your deals or a guarantor of your work.
3. Truthful listings
When you submit a listing you declare, and are responsible for ensuring, that:
- You own the property or have the owner's written authorization to list it, and will show it to us if asked.
- The description, measurements, price and availability are accurate, and you will keep them current. You will take the listing down as soon as the property is sold or no longer available.
- The price is the seller's asking price, with no hidden charges. If there are other mandatory costs, such as maintenance fees, you state them.
- The photos and videos are of that property and you have the right to publish them.
- If it is an off-plan or under-construction project, it has the required permits (such as the building licence), and you will tell us if it is sold through a trust (fideicomiso).
- The listing is not misleading under article 88 of Dominican Consumer Protection Law 358-05.
4. Non-discrimination
No listing or conduct may discriminate against buyers or tenants on grounds of race, colour, nationality, religion, sex, sexual orientation, disability, marital status or any other personal characteristic.
5. Enquiries and buyers' data
- When a buyer writes to you through the site, you receive their details with their consent and only to answer that enquiry. From then on you are responsible for handling them under Law 172-13 and, if the buyer is in the European Union, the GDPR.
- You may not add them to mailing lists, pass them on to others or send them marketing without their separate consent (Law 310-14). If they ask you to delete their data, you must do so.
6. Anti-money-laundering
Real-estate agents are obliged parties under Law 155-17 against Money Laundering and Terrorist Financing. You are responsible for meeting its obligations: customer due diligence, record keeping and reporting to the Financial Analysis Unit (UAF), under the DGII's rules. HomeDominican does not handle payments or receive funds from any deal. Never ask a buyer to pay on HomeDominican's behalf.
7. Reviews
We verify and publish the reviews on your profile. You may not write reviews about yourself or competitors, ask relatives or employees for reviews without that relationship being disclosed, or offer anything in return for a review or for a positive one. Nor may you pressure anyone to remove a negative review. If you do, we may remove your reviews and suspend your account.
8. Plans and prices
- Creating an account, having a directory profile and publishing listings is free.
- The Premium plan, the monthly statistics report and "Recommended services" placements are paid. Their price including taxes, duration and payment method are agreed in writing before they start, and we issue an invoice.
- You can cancel a plan at any time; it stays active until the end of the paid period. While active, we label it on the site as paid content.
- Paying never changes a verification result or the order of listings.
9. Licence to your content
You keep the rights to your texts and photos. You give us free permission, while the content is published, to show it on the site and in its promotional materials, translate it into English or Spanish, and adapt its format, for example cropping or compressing photos. When you take a listing down, we stop showing it.
10. Your data and statistics
Your verified profile is public. We record statistics about your listings (views, WhatsApp taps, saves and enquiries) without identifying visitors. If you have the monthly report, we draft it with AI assistance (Claude, by Anthropic) from those figures. More in the privacy policy.
11. Taking listings down and closing your account
You can take a listing down from your dashboard at any time. To close your account, write to us from your login email: we'll take down your profile and listings.
12. Liability
You are responsible for the content you publish and for your services, towards buyers and towards HomeDominican, including third-party claims over false, misleading or infringing listings. HomeDominican is not liable for your deals or your agreements with clients.
13. Changes and governing law
If we change these terms, we'll let you know by email or in your dashboard before they apply. They are governed by the laws of the Dominican Republic.
